ASIC clarification gives crypto users access to AFCA

Australian crypto investors can now access formal dispute resolution via AFCA for licensed platforms, bringing digital assets under standard financial services consumer protections.

What happened

ASIC clarified under Information Sheet 225 when digital assets qualify as financial products, requiring providing businesses to hold an Australian Financial Services Licence and join the Australian Financial Complaints Authority. Consumers using qualifying digital assets, stablecoins, tokenised securities, and wallets can now escalate unresolved disputes to AFCA's free independent resolution service if their provider is an AFCA member.

Why it matters here

This regulatory shift removes ambiguity surrounding digital asset oversight and establishes mandatory consumer protections across compliant Australian crypto platforms. For investors and fintech operators, clearer AFSL requirements and AFCA coverage increase institutional legitimacy and reduce counterparty compliance risk across local digital asset markets.

What to watch

ASIC regulatory updates and AFCA's financial firm search tool to verify whether local digital asset platforms and wallet providers hold active AFCA memberships.
