ASIC sets firm September deadline for crypto licensing

Digital asset firms relying on ASIC's temporary guidance must apply for an Australian Financial Services Licence by 30 September 2026. Unlicensed entities face civil or criminal penalties starting 1 October.

What happened

The Australian Securities and Investments Commission warned crypto businesses operating under its temporary no-action position to lodge an AFSL application before 30 September 2026. Entities failing to submit by the deadline risk breaching financial services laws from 1 October and facing civil or criminal enforcement. Over 45 businesses have applied since guidance was updated in October 2025.

Why it matters here

Australian investors using local digital asset exchanges could experience service interruptions if their platform fails to meet ASIC's strict licensing cutoff. While formal regulatory oversight strengthens consumer protection and industry legitimacy long term, non-compliant platforms will be forced to cease offering financial services legally in Australia from October.

What to watch

The mandatory 30 September 2026 financial services licensing application cutoff for digital asset firms and subsequent regulatory enforcement actions by ASIC starting from 1 October.
