Treasury Drafts CARF Rules To Expand ATO Crypto Visibility

Crypto investors and service providers face comprehensive tax reporting requirements as the ATO integrates international standards to track digital asset transactions and tax obligations.

What happened

The Australian Treasury released draft legislation implementing the OECD's Crypto-Asset Reporting Framework, domestic reporting rules, and expanded Common Reporting Standard rules. Reporting crypto-asset service providers will be required to collect customer identifying data, tax residence information, purchase values, and gross sale proceeds for exchange and transfer transactions to assist ATO compliance.

Why it matters here

The framework provides the ATO with detailed transparency over domestic and offshore crypto activity, eliminating reporting loopholes for Australian taxpayers. Crypto investors must maintain detailed records of transactions, swaps, and transfers, as automated data matching will make unreported capital gains or ordinary income easily identifiable by tax authorities.

What to watch

The closing of public Treasury consultation on 28 October 2026 and subsequent ministerial regulation announcements.
